These Terms of Service ("Terms") govern your access to and use of the AlamoCareers website and related services (collectively, the "Platform"). Please read these Terms carefully. If you do not agree to these Terms, you may not use the Platform.

1. Accounts and Registration

To use certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 18 years old to create an account, upload a resume, post a job, or otherwise use the Platform. By creating an account, you represent and warrant that you meet this age requirement.

2. Terms for Job Seekers

2.1 Accurate Profiles

You agree to provide truthful and accurate information in your profile, including your work experience, skills, education, and veteran or military status if you choose to provide it. Misrepresentation may result in account suspension or termination.

2.2 Stealth Mode

Stealth Mode allows you to control how much of your profile is visible to employers. You are responsible for reviewing and adjusting your privacy settings. Enabling or disabling Stealth Mode does not affect information you have already shared with employers through applications or messages.

2.3 Reporting Listings

If you encounter a suspicious or misleading job listing, you may report it to us. By submitting evidence, you grant AlamoCareers a limited license to review and use that evidence for the purpose of investigating the report and enforcing these Terms.

3. Terms for Employers

3.1 Verification

Employers must provide accurate business information, including a valid Employer Identification Number (EIN) where applicable. We reserve the right to verify your business identity and to withhold or remove listings until verification is complete.

3.2 Active Listings

You agree to maintain accurate and current job listings. If a position is filled or no longer available, you must promptly update or remove the listing. Listings that remain inactive for an extended period may be flagged by our systems and removed.

3.3 Prohibited Listings

You may not post listings that:

• Advertise jobs that do not represent a genuine, current hiring need ("ghost jobs").
• Contain false, misleading, or deceptive information about compensation, location, duties, or working conditions.
• Discriminate on the basis of race, color, religion, sex, national origin, age, disability, veteran status, or any other protected characteristic.
• Promote illegal activity, pyramid schemes, multi-level marketing, or unpaid internships that violate wage and hour laws.
• Require applicants to pay upfront fees, purchase starter kits, or pay for training.

3.4 Applicant Communication

You agree to communicate professionally with applicants and to provide timely updates on application status. Repeated failure to respond to applicants may result in warnings, reduced visibility, or account termination.

4. User Conduct

All users agree not to:

• Use the Platform for any illegal or unauthorized purpose.
• Harass, abuse, threaten, or discriminate against other users.
• Scrape, crawl, harvest, or otherwise collect data from the Platform without our written consent.
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
• Upload viruses, malware, or other harmful code.
• Circumvent or attempt to circumvent any security or access controls.
• Use automated means to create accounts, send messages, or interact with the Platform.

5. Content and Intellectual Property

5.1 Your Content

You retain ownership of any content you submit to the Platform, such as resumes, profiles, job descriptions, and messages. By submitting content, you grant AlamoCareers a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your content solely for the purpose of operating and improving the Platform.

5.2 Our Intellectual Property

The Platform, including its design, code, logos, trademarks, and fraud-detection systems, is owned by AlamoCareers and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Platform without our prior written consent.

6. Payments, Credits, and Refunds

Certain features of the Platform require payment, such as featured job boosts, subscriptions, and broadcast credits. All fees are stated at the time of purchase and are subject to change upon notice.

• Subscriptions: billed in advance on a recurring basis unless cancelled. Cancellation takes effect at the end of the current billing period.
• Credits: broadcast credits and similar digital credits have no cash value and are non-transferable. Credits unused at the time of account termination due to a violation of these Terms will be forfeited.
• Refunds: all purchases are final unless otherwise required by law or explicitly stated at the time of purchase. If you believe you were charged in error, please contact us within 30 days.

7. Termination and Suspension

We reserve the right to suspend or terminate your account, remove your content, or restrict your access to the Platform at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent activity, or otherwise posed a risk to the Platform or its users.

You may also delete your account at any time through your account settings. Upon termination, all licenses granted by you to AlamoCareers will cease, and we may retain certain information as required by law or for legitimate business purposes.

8. Disclaimers

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties or representations, express or implied, regarding the reliability, accuracy, completeness, or availability of the Platform. We do not guarantee that you will find a job or hire a candidate through the Platform.

AlamoCareers is a marketplace that connects job seekers and employers. We are not an employer, recruitment agency, or party to any employment relationship or contract formed through the Platform.

9. Limitation of Liability

To the fullest extent permitted by law, AlamoCareers and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform.

Our total liability to you for any claim arising from or relating to these Terms or the Platform will not exceed the greater of (a) the amount you paid to AlamoCareers in the 12 months preceding the claim, or (b) $100.

10. Indemnification

You agree to indemnify, defend, and hold harmless AlamoCareers and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Platform, your content, or your violation of these Terms.

11. Dispute Resolution

11.1 Governing Law

These Terms and any dispute arising from them will be governed by the laws of the State of Texas, without regard to conflict of law principles.

11.2 Informal Resolution

Before filing any formal legal action, you agree to contact us and attempt to resolve the dispute informally. We will work with you in good faith to address your concerns.

11.3 Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform that cannot be resolved informally will be resolved through binding arbitration administered by a mutually agreed arbitration provider, conducted in San Antonio, Texas, in accordance with the applicable rules. The arbitrator's decision will be final and binding.

You agree that any arbitration will be conducted on an individual basis only, and not as a class action, collective action, or representative proceeding.

11.4 Exceptions

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.

12. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and AlamoCareers regarding the Platform.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

Changes: We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms.
